  6. SEC. 1201.  SHORT TITLE
  7.    This subtitle may be cited as the "Controlled Substance Analogue
  8. Enforcement Act of 1986".
  9.  
  10. SEC. 1202.  TREATMENT OF CONTROLLED SUBSTANCE ANALOGUES
  11.    Part B of the Controlled Substances Act is amended by adding at the end
  12. of the following new section:         [sic?]

  14.             "TREATMENT OF CONTROLLED SUBSTANCE ANALOGUES"
  15.  
  16.    "SEC 203.  A controlled substance analogue shall, to the extent
  17. intended for human consumption, be treated, for the purposes of this
  18. title [Title I; "Enforcement"] and title III ["Interdiction"] as a
  19. controlled substance in schedule I."
  20.  
  21. SEC 1203.  DEFINITION.
  22.  
  23.    Section 102 of the Controlled Substances Act (21 U.S.C. 802) is
  24. amended by adding at the end thereof the following:
  25.     "(32)(A) Except as provided in subparagraph (B), the term `controlled
  26.    substance analogue' means a substance ---
  27.         "(i) the chemical structure of which is substantially similar to
  28.       the chemical structure of a controlled substance in schedule I or II;
  29.         "(ii) which has a stimulant, depressant, or hallucinogenic effect on
  30.       the central nervous system that is substantially similar to or greater
  31.       than the stimulent, [sic] depressant, or hallucinogenic effect on the
  32.       central nervous system of a controlled substance in schedule I or II;
  33.         "(iii) with respect to a particular person, which such person
  34.       represents or intends to have a stimulant, depressant, or
  35.       hallucinogenic effect on the central nervous system that is
  36.       substantially similar to or greater than the stimulant, depressant, or
  37.       hallucinogenic effect on the central nervous system of a controlled
  38.       substance in schedule I or II.
  39.     "(B) Such term does not include ---
  40.         "(i) a controlled substance;
  41.     "(ii) any substance for which there is an approved new drug
  42.       application;
  43.         "(iii) with respect to a particular person any substance, if an
  44.       exemption is in effect for investigational use, for that person, under
  45.       section 505 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C.
  46.       355) to the extent conduct with respect to such substance is pursuant
  47.       to such exemption; or
  48.         "(iv) any substance to the extent not intended for human consumption
  49.       before such an exemption takes effect with respect to that substance.".

  51. SEC. 1204.  CLERICAL AMENDMENT.
  52.  
  53.    The table of contents of the Comprehensive Drug Abuse Prevention
  54. and Control Sct of 1970 is amended by inserting after the item
  55. relating to section 202 the following new item: "Sec. 203.  Treatment
  56. of controlled substance analogues.".
